Rust Film Case: Alec Baldwin’s Lawyers Seek Prosecutor Disqualification

Days before the start of the Rust film trial, Alec Baldwin’s lawyer is taking action. She filed a motion to dismiss special prosecutor Andrea Reeb. The reason for this action is that she is involved in two branches of government. She is active in the legislative branch and as a special prosecutor, considered not under the law.

The lawyer emphasized that her participation could affect the trial. This is considering that the state legislature is the one who approves the funds to carry out the investigations of the case. Although Reeb may refuse to vote to request the resources, his presence alone could change the landscape of things, according to Baldwin’s attorney’s statement.

Alec Baldwin’s attorneys filed a motion on Tuesday. In this instance they requested that he remove Reeb as special prosecutor in the Rust film case. They argued that his presence could attract funding for the prosecution, which they consider unfair.

On that day Baldwin’s lawyers wrote the following in the motion “Doing so vests two core powers of different branches – legislating and prosecuting – in the same person 

and is thus barred by the plain language of Article III of the New Mexico Constitution”. 

They later said, regarding the Rust film case, “Were the arrangement here approved by the courts. Future District Attorneys could seek to curry favor with legislators who control their budgets by appointing them to high-profile cases – distorting the legislative process”.

The lawyers claim that Reeb’s staying on the case could attract more funding and hurt their client. In fact, the local governor requested additional funding of $317,000 for the investigations.

Prosecution’s Response To The Actor’s Incident

The response from the prosecutor’s office was not long in coming. They commented that such action is a tactic to distract attention. Among the statements they have made regarding the Rust film case, they said, “Mr. Baldwin and his attorneys can use whatever tactics they want to distract from the fact that Halyna Hutchins died because of gross negligence and a reckless disregard for safety on the ‘Rust’ film set”.

Brewer then said: “Mr. Baldwin and his attorneys can use whatever tactics they want to distract from the fact that Halyna Hutchins died because of gross negligence and a reckless disregard for safety on the ‘Rust’ film set.

The prosecutor’s office also stated, “Should any legislation before the House create a conflict of interest for her, Andrea would continue her record of doing the right thing and recuse herself from the vote,”.

Next February 24, is the start of the trial for the Rust film case. This day we will know the cases and the statements of both parties. . For its part, the prosecution claims it is time for the actor to pay for his crimes. For now, he is charged with involuntary manslaughter.
